In other news these days, not exactly encouraging, in legal bloggers Italic.
Is making the rounds of the blogosphere (and beyond) the news of the first conviction of a blogger for "underground press" . The Court of Modica (RG) has, in fact, condemned the notorious Sicilian historian Carlo Ruta to a monetary penalty on charges of "irregular schedule" for his blog www.accadeinsicilia.net.
For various reasons a another blog had been seized by the Postal Police following a libel suit, the problem is that for a single post indicted the entire site has been subjected to seizure and became subject, in fact, a prior censorship .
The news leaves me very puzzled and, in comments before describing legal aspect of reading the text of the measures, it is certain that some decisions are the result of poorly written rules, difficult to interpret and apply, daughters of a poor computer literacy. The only possible solution, if we resign ourselves to comment on such decisions, is to rewrite the rules taking into account the special characteristics and potential of the Web
But not all! Via Mark Camisani Calzolari learn the story of another blogger who had post about his experience, not positive, a customer of a furniture factory that, in the comments, the anticipated legal action, with a covering of 400.00 euros compensation.
Blogger and responsibilities, a recurring theme that the legislature will address soon. In Italy as part of the controversial reform of publishing planned for the autumn and at Community level, the European Parliament has drafted a document that will surely discuss as it relates to regulation of a controversial blog.
The report, signed by MEP Marianne Mikko, relates to the concentration and pluralism of the media in the EU but also addresses the aromento blogs and social media.
The report attributes the blog Mikko an ambiguous role: on the one hand, these are seen as a positive factor of dynamism and innovation on the other "ltresì considering that the status of their authors and publishers, including legal status, is not clearly defined is shown to readers of weblogs, which is a source of uncertainty regarding the fairness and reliability of the information, source protection, applicability of codes of conduct and the attribution of responsibility in the event of legal action. "
To overcome this drawback the Mikko proposes to "create a brand of quality assurance" through the establishment of a register in which each blogger can (voluntarily) to declare their financial interests and professional.
The report also deals with Mikko, more generally, the fact that commercial publications are increasingly using content produced by users, especially audiovisual content, upon payment of a fee is often symbolic, and that this raises issues of unfair competition between operators the media sector.
For this reason, the Culture Commission of the European Parliament currency with interest the possibility of introducing a fee for propra and compensation commensurate to the value of content produced by users, plus the adoption of a proper code of ethics.
