Law & Technology - Article of the Week: Inaugural Post

Every day I read dozens of posts and many interesting items on the right of new technologies, some of them point out Twitter and others will add in my Delicious .

Rather than keep them hidden among my favorites, I thought it might be a good service to 2.0 Right to share what I think is the most interesting article on the week.

This week I decided to report an article written by Andrea Monti titled " They're legal to reverse auction? ". The article attempts to answer a question that many (entrepreneurs and users) were placed in the latter period, we have all heard that these auctions are a lot of gambling prohibited by law. I always thought that this solution was too superficial and that the assertion that the Dutch auction would still be illegal is too simplistic and legally risky.

Monti analyzes the issue in a simple but effective starting with an analysis of the phenomenon and, after enucleated profiles most relevant legal, comes to a very reasonable:

The answer to the question "are legal, the Dutch auction" is, then, "yes, but not always."

The article by Monti has therefore the honor to address the issue from a legal standpoint, overcoming objections preconceived which covered these kinds of auctions: the legality of reverse auction depends greatly on the accuracy of the vendor and how the individual system is actually structured.

In addition to frame the legislative point of view the sector, principlamente answering the question if these auctions can be considered as such, or gambling, you should also talk about the possible control you should have on bets and winnings. Unfortunately there are many sites that have been scammed users, changing the information directly from their control panel. From my vantage point, however I'm noticing a "generational change" in which new sites, primarily BidofLuck, take more attention to transparency. We also look in the forum to the legal point of view this issue.

    My minor child has played with my supervision, and has won a game for the wii since the auction was for beginners was almost too easy, then when we had to do the transaction for the payment (0.02 cents.) We have had to enter data and Cod.Fiscale and on-screen viewing experience that is FORBIDDEN have appeared minor and therefore invalid even think the payoff given that as of now we have not yet been answered .... However, the deposit that we had to play was received.
    Then I recorded myself and when I approached the auction price for Volvo I have not been able to make deposits .... even if the card is active and covered ...... then I saw the decline continuing with offete various deposits without they were registered as an offering ....
    I think all this is unclear, partly because those who win are the same people and this is very fishy ..... or maybe have a BAZAR for reselling innnnnumerevoli objects as well as all the same, but the most expensive in the auction.
