In recent days there was much talk of Certified Mail (PEC) in relation to ' government initiative to give all citizens who request a "PEC box."
It 'was finally published in the Official Gazette (No 119 of May 25, 2009) Decree of the President of the Council of Ministers of 6 May 2009 which sets out the provisions for the issuance and use of the PEC box assigned to the citizens.
The decision to give the PEC had already been issued under the Act January 28, 2009, n. 2 who converted the so-called "Anti-Crisis Decree" (Decree Law 29 November 2008, n. 185). In particular, the art. 16 - bis, paragraph 5, provided that "to facilitate the achievement of maximum diffusion of telematics technologies in communications, under the Digital Administration Code, referred to in Legislative Decree 7 March 2005, n. 82, to citizens who request them and 'given a box of certified mail. " The same article, paragraph 7, provided that the conditions for issuing and use of the PEC box would be defined by the Decree of President of the Council of Ministers to be issued within 90 days after the entry into force of the law.
As mentioned before, after ' examination in the Unified State-Regions Conference , the decree was issued and published in the Official Gazette.
We see, in concrete terms, what it provides.
Every adult citizen who requests it, you can get for free ("without the oner") a certified e-mail address.
The assignment procedure consists of two phases: a) a web registration by entering your data and choosing a password b) successfully completed the registration, the citizen should go to a public office for the activation provided of a valid identity document and the document containing the tax code. The office will verify the correctness of the data and deliver to the applicant's credentials to access the service PEC.
Since then, however, the citizen must be aware that your e-certified e-mail address becomes valid to all intents and purposes legal relations with all Italian public administrations, coming - in fact - to replace the physical residence (or domicile).
In fact, art. 3, paragraph 4 provides that Dpcm May 6, 2009
"The will of the citizens as expressed in art. 2, paragraph 1, is the explicit acceptance of the deployment, using PEC from
public administrations of all measures and actions which concern him "
It now seems clear that the PEC is not really free, the city does not pay a monetary price for the activation and use, but in return gives their consent to receive documents by email only. In my opinion this is a true "counter-" and the publicity that is made of this initiative is likely to be tricky!
This rule exposes a bluff: the PEC does not need the state to have a PA digital but only to save the cost of paper and notifications. Once again, the center is not the citizen but the Public Administration and its requirements.
The certified electronic mail, in fact, is not sufficient for sending instances seen that Article. 4, paragraph 4 of Cabinet Decree provides that the government continue "to require digital signature" (though the state does not give the whole PEC).
On May 6, 2009 Decree also provides that - as already expected from CAD - the PA activate at least one box PEC whose address shall be communicated to CNIPA which will establish a proper public address book with the addresses of the Italian government.
In fact as early as 1 January 2006, the PEC is mandatory for Italian PA and addresses should be published on the websites of their own but it is a provision breached by almost all administrations.
One last mention deserves the art. 6 Dpcm May 6, 2006 which deals with the allocation of PEC box public employees. Even the art. 16-bis, paragraph 6, of Law no. 2/2009 stipulated that the government use the Certified Mail for "communications and notifications addressed to employees with the same or other public administration", this rule is not, therefore, that civil servants be given a PEC box. Be careful though: at the time of allocation will be asked if "use the same for the purposes of Article .16-bis, paragraph 6". Translated from giuridichese, in case of agreement, this would mean that the employee would pay the Municipal Administration of Rome agreed to receive notification of any act to his office address, including - for example - the high fines of the City of Milan .
The Decree provides, finally, that the choice of the private company that will provide the State the PEC service for citizens and activated specific tender procedure, on issues which have already expressed so totally agree with his friend Guido Scorza , whose Article reference .
Here, let me just some brief thoughts.
The assignment of the PEC to all citizens, while governed by the best intentions, recall of becoming yet another failure of the Italian digital PA.
The PEC was a resounding flop and we can not hide it: do not use neither citizens nor businesses, or the same public administration . It is not a cost problem: all of us use a PC and a connection that has a cost, without the gifts that the state there, simply because it is useful technologies which we feel the need.
So it's not for the PEC and innovation policy should seriously should include monitoring of the usage data.
From this monitoring is apparent that this is a model that is to be abandoned. Insist on this road and invest in other resources can only lead to another failure.

The only observation is shared on the content of the e-mail should be digitally signed. And 'the real problem!
The digital signature is the real flop and the PEC.
All they would know to use the PEC. It 's simple and intuitive and does not involve training.
The rules for use are clear and easily understandable.
The real problem is the signature, its real-time and immediate legal validity, the need for conservation over time, its actual use (smart card, token, attached, detatched, Adobe or Microsoft).
And 'in this context that the legislature should focus!
Allow me to point out that the PEC is a typically Italian invention.
How come no one feels the need, if not us?
Without doubt, the digital signature and how it applies to the various documents and mail is by far the most effective and logical than stranirsi with email and other special .....

The sin is a great tool if all they use it, besides being a paper savings for the state also applies to the consumer (paper file at the Post Office, petrol ...) and it is not true that only the Italians use it because else a law that obliges the European nations to use it we have introduced the first.

In the other countries are used (successfully) other standard, perhaps it would be wise to learn from others.
OK for now no one uses it ... unfortunately still people do not even know what it is ... slowly take more and more ground, and unfortunately only a few years everyone will use it even though I think the traditional mail will never go away! The PEC will be used only for sending invoices, documents, reminders etc.. etc..

Typically Italian yet another disappointment, last week I turned on the Pec, first via the internet through the website of INPS, then at the headquarters of INPS Collegno this far and everything: unloading the mail and arrives almost immediately The confirmation of the box, Pec, I send an email to the ASL of Biella for the renewal of the license, I tried the site http://www.indicepa.gov.it/ government agency, and using the internal search engine I found the Pec ASL Biella, write and send my mail: surprise! the server replies that the e-mail which I sent to the email address is not a government! Pulling some of those sums which are the numbers of PEC in 2009 by certified mail domain registrations grew by 216%, reaching 70 000 fee, for a total of over one million 350 thousand boxes total (+350% ). The number of messages exchanged grew by more than 40%.
The increase in exchange of e-mails certified has increased much less than the growth of the boxes pec, is perhaps the little information that the user has on this type of mail?
