A growing number of legal provisions relating to the Internet and new technologies. Often, however, these rules are included in measures bodied and complex, and are written in a very cryptic, they are factors that affect the knowledge and the intelligibility of the rules by those called upon to apply them.

In this respect, the case is particularly emblematic of 'art. 42 Act July 7, 2009, n. 88 (called " The Community egge 200 8 "), a measure - approved on an annual basis - contains provisions for the fulfillment of obligations deriving from Italy to the European Communities.

As you can imagine, this is a very divided decision, in which there is a norm on the web sites listed, so far, has said little.

The 'art. Law No. 42. 88/2009, in fact, changing the 'art. Civil Code of 2250, introduces new disclosure requirements for companies via the Web, corporations, limited partnerships and limited liability companies that have limited "by an electronic space for the communication connected to a computer network to access public "must provide - through this medium - the following information:
a) the registered office, the registrar of companies at which the company is registered and the registration number;
b) the share capital, stated according to the amount actually paid and what is existing since the last budget;
c) the possible liquidation of the company;
d) if, in the case of SpA or Srl, the company has a sole member.

Since the Law n. 88/2009 is already in place, companies have not done so should immediately update their Web sites with information listed first. But updating the company website does not appear sufficient to comply with the regulation, in fact, the term "electronic space for the communication network connected to an electronic public access" certainly includes the Web sites, but also all the other virtual communication, including company profiles on social networks.

Be careful not to underestimate this simple accomplishment: his failure to comply, within the meaning of 'art. Civil Code 2630, exposes the company to a fine of between 206 Euros to 2065 Euros.
