A few months ago, I greeted the announcement with enthusiasm, given by the Minister for the simplification of legislation on the project of building an online database that would allow the free consultation to all applicable laws.

The portal, built by ' Government Printing Office and Mint State , is on line for several days (in beta), and - albeit with some delay from the date originally scheduled - should be operational by 1 March 2010.

For years, I believe that access to the rules on the Net is the first step for an administration truly digital and, therefore, I rushed to see him curious and confident, and my expectations, however, were soon disappointed.

The site, located at www.normattiva.it (but should not be reduced and rationalized public domain names?), has a page called "Legal Notice" which specifies that:

The only official text and the final is released on the Italian Official Gazette in the press, which prevails in cases of discrepancy.

These notices is inexplicable and absurd. Think, for example, that - as readers of this blog will remember - December 31, 2008 has ceased in the dissemination of government paper version of the Official Gazette, and then, in the Official Gazette is published the text of existing measures, but that the original (called "historic"). Not to mention the fact that the Law n. 69/2009 (approved only a few months ago) has finally provided that the publicity of the acts of government are given via their respective Web sites, with full legal validity.

Things do not improve if you continue reading the page "Legal Notice" of the site Normattiva:

Reproduction of the texts provided in electronic form is permitted provided the source is acknowledged, the non-authentic and free. The texts are available to users for informational purposes only. The collection, however vast, is the result of a selection of drafting. The Presidency of the Council of Ministers and the Government Printing Office and Mint SpA, are not responsible for any errors or inaccuracies, as well as for damages resulting from actions or decisions taken based on the consultation Portal.

This disclaimer, it would be legitimate in any private database, it is unacceptable for a public site! Why should I mention the source in case of summons? The rules are perhaps covered by copyright? I do not know. What sense does it say that the texts of the law (which is not admitted ignorance) are available for informational purposes only? And then, it is possible that in 2010 - came after providing for a reduction in the number of laws - a government site is unable to give me a digital text "of course"?

I am very disappointed in the other countries are successfully pursuing the philosophy of ' Open Data (Gigi Cogo had spoken of here ), while in Italy for safety on a provision of law we must have a printed Official Gazette. Where? Of course at the State Printing Office , which developed the site Normattiva.

During my seminars, often narrative that Dionysius I , tyrant of Syracuse, hung on the walls the city's highest laws enacted by him in order to make it difficult for citizens to know and apply them in this way he could ever punish them for failure to comply .

Well, after more than 2000 years, what has changed?

    WHAT YOU WRITE would give you reason, only when the drafting of normattiva continue to maintain this disclaimer and limitation of liability, even when the Empowerment Website Project would be completed in late 2014 ... when the second lead editorial format multivigente and navigable hypertext and dynamic link access to the entire production Italian legislation since 1860 ... what's the point to take responsibility for what you're posting, if the portal AND 'BUILDING IN FULL! you come before 2014, do do do apply multivigente and dynamic links to all the texts, please publish all laws, ......     place the contents in this post is my point of view (this blog is not a newspaper), I disagree with what you say and still think that this clause is absolutely wrong, and this for at least two additional reasons:
    a) the fact that the project is divided into several phases does not imply that the content is published on an experimental basis;
    b) the comparison of the yard is not at all in point: if the works are in progress I do not get people ... the same way, the contents of which are public normattiva must already be complete and reliable ... otherwise what sense does it publish?

    For the rest I do not understand why, at the bottom of your comment, you turn to Guido Scorza.

    1) if they had written that the contents were experimentally +'d be happy?

    2) the fact that he published the texts, not taking responsibility for what is published, making the site the same way as any other web site information is not reliable ... if so .... then when the project will be finished in 2014 then you have reason in raising these criticisms if you keep these disclaimers .....
    I think that if a site is under construction, nothing prevents the employer to publish photos of the yard, step by step in its construction ....
    as an entrepreneur to do nothing to prevent people entering the construction site warning them to beware, and do not rely on the presumption that there are railings, may not be there and make you fall down ......

    maybe I'm wrong ... but this is my opinion ....

    1) is not a speech to be happy, but as things you can do and will do the rest of the world (just look at are of http://www.legislation.gov.uk) , in my opinion is absurd that the same person who prints the Official Gazette is unable to provide the same level of reliability to a Web page.

    2) normattiva is not any informative site, but an institutional site created precisely to provide a service to the citizen.
